Terms of Service

Last updated: 20 October 2026

1. About these terms

Parkbench is operated by Michael Leigh Stewart, a sole trader trading as Parkbench AI (ABN 52 710 661 081), Australia (“we”, “us”). By creating an account or using Parkbench you agree to these terms. If you do not agree, please do not use the service.

2. Who can use Parkbench

You must be at least 16 years old to use Parkbench. If you are under 18, please read these terms with a parent or guardian and make sure they are comfortable with you using the service.

3. Your account

  • Give accurate information when you sign up, and keep your email address up to date.
  • Keep your password secure and do not share your account. You are responsible for activity on your account unless it happens because of our failure.
  • Tell us promptly at michael@parkbench.ai if you think someone else has accessed your account.

4. The service

Parkbench lets you talk with AI personalities, keep journals, and create meditations, sleep stories, conversations, music, images and other content. Some features are free and some require a Premium subscription. Features marked as experimental or in development may change, behave unpredictably or be withdrawn.

We work to keep Parkbench available and reliable, but it is run by a small business on cloud infrastructure. There may be downtime, delays in generating content, or failed generations. We may apply usage limits to keep the service fair and stable.

5. AI-generated content and its limits

Everything a Parkbench personality says or creates is produced by AI models. AI personalities are not people, even when they remember things about you or write in a personal voice. AI output can be inaccurate, incomplete, out of date or inappropriate, and it may not reflect our views.

  • Not professional advice. Parkbench does not provide medical, psychological, legal, financial or other professional advice. Wellness content is for relaxation and reflection. It is not therapy or a substitute for care from a qualified professional.
  • Not a crisis service. If you or someone else is in danger, call 000. In Australia you can also contact Lifeline on 13 11 14.
  • Listen safely. Do not listen to meditations or sleep content while driving, operating machinery or doing anything that needs your full attention.
  • Use your judgement. Check anything important before you rely on it.

6. Acceptable use

When using Parkbench, you must not:

  • break the law, or use Parkbench to harass, threaten, defame or harm anyone;
  • upload a voice recording of another person, or create a personality that imitates a real person, without that person's permission;
  • create or share sexual content involving minors, content that promotes violence or self-harm, or content that infringes someone else's rights;
  • impersonate someone or misrepresent your connection with any person or organisation;
  • try to get around usage limits, safety checks or access controls, or access another person's account or data;
  • interfere with the service, introduce malicious code, or scrape or bulk-download content by automated means; or
  • resell or provide Parkbench to others as part of your own service without our written permission.

7. Your content

You keep ownership of what you put into Parkbench, including your messages, journals, voice samples, uploads and prompts (“your content”).

You give us a non-exclusive, worldwide, royalty-free licence to store, copy, process and display your content only as needed to run Parkbench for you. That includes using it to generate responses and content, remember context, check quality and safety, and show content you choose to share. This licence ends when your content is deleted, except for copies we must keep by law, copies in backups until they expire, and content others have already received through sharing.

You confirm you have the rights and permissions needed for your content, including the consent of anyone whose voice is in a recording you upload.

8. Using generated content

You may use text and images generated for your account, including chat replies, journal text and generated images, for personal or commercial purposes.

Voice, music, and video that includes them are for your own personal, non-commercial use. If you want to use those commercially, contact us first. Some of the models and voice recordings we use do not allow us to give you broader rights.

Generated content may be similar to content created for other people, and it may not be protected by copyright. We do not promise that generated content is unique or that it does not resemble existing works. You are responsible for how you use and share it, and for respecting other people's rights.

9. Our intellectual property

Parkbench's software, design, branding, built-in personalities, stock voices, and the content those personalities publish to the community belong to us or our licensors. You may use them only through the service as these terms allow.

If you send us feedback or suggestions, we may use them to improve Parkbench without owing you anything.

10. Community and sharing

When you make content public, such as a public generation, community comment, public profile or message, other people can see it and may share it further. Be thoughtful about what you share, especially personal information. We may remove content or restrict sharing if it breaches these terms or creates a risk to others. You can block other users.

11. Premium subscriptions

Price

Premium is a pay-what-you-want monthly subscription paid by card through Stripe. You choose the amount, subject to the minimum shown when you subscribe. The default shown is US$5. Prices are in US dollars (USD); your bank may charge currency conversion fees. Parkbench AI is not registered for Australian GST and does not charge Australian GST.

Card subscriptions (Stripe)

  • You are charged when you subscribe, then automatically each month on the same billing date.
  • Your subscription renews automatically until you cancel. Your next billing date is shown on the Subscription page.
  • If you change your monthly amount, the change takes effect straight away and Stripe immediately charges, or credits you for, the prorated difference for the rest of the current billing period.
  • If a payment fails, Stripe may retry it. Premium features may be paused until payment succeeds.
  • You can update your payment method through the Stripe billing portal, linked from the Subscription page.

Cancelling

You can cancel at any time from the Subscription page. You will not be charged again, and Premium stays available until the end of the period you have already paid for. Cancelling does not delete your content. To delete your data or account, see our Privacy Policy.

Refunds

Because you can cancel at any time and keep access until the end of your paid period, we do not normally refund partial months or unused time. This does not affect your rights under the Australian Consumer Law (see section 12). If something has gone wrong, such as a duplicate charge or a charge after you cancelled, email michael@parkbench.ai and we will look into it.

Changes to Premium

We may change what Premium includes or how it is priced. We will give you at least 30 days' notice by email before a price change affects you, and you can cancel before it takes effect. The amount you chose will not increase without your agreement.

12. Your consumer rights

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

13. Liability

Apart from the guarantees and rights described in section 12, and to the extent the law allows, Parkbench is provided “as is”. We do not promise that it will always be available, error-free, or that AI output will be accurate or suitable for a particular purpose.

To the extent the law allows, we are not liable for loss that arises from your reliance on AI-generated content against the guidance in section 5, or from your breach of these terms. Nothing in these terms limits liability that cannot lawfully be limited, including for personal injury caused by negligence.

14. Suspension and closing your account

You can stop using Parkbench at any time. You can close your account from Settings, which deletes your personal data and cancels billing. You can also email michael@parkbench.ai.

We may suspend or close an account if it seriously or repeatedly breaches these terms, if we need to protect other people or the service, or if the law requires it. Unless it would be unlawful or create a risk, we will tell you why and give you a chance to respond. If we close your account without a breach on your part, we will refund any unused prepaid subscription period.

15. Changes to the service and these terms

We may update these terms as Parkbench changes. If a change materially affects you, we will tell you by email or in the app at least 30 days before it takes effect. If you do not agree with the change, you can cancel your subscription and stop using Parkbench before then. If we discontinue Parkbench, we will give reasonable notice and a chance to download your data.

16. General

These terms are governed by the laws of New South Wales, Australia. If any part of these terms is unenforceable, the rest continues to apply. If you have a concern or dispute, please contact us first at michael@parkbench.ai so we can try to resolve it informally.
